Terms & Conditions

Last updated: 23 September 2026

These Terms & Conditions apply to photography services provided by Meena Julien trading as Loving Memories Funeral Photography.

By booking my services, you agree to these Terms & Conditions.

I understand that funeral photography is different from other types of photography. My aim is to provide a discreet, respectful and professional service at a difficult and emotional time.

1. Booking

A booking is confirmed when:

  • I have confirmed that I am available for the requested date;

  • you have provided the information I need to carry out the photography;

  • you have agreed to the quoted price; and

  • the £150 booking payment has been received.

I will confirm the booking details with you in writing.

These Terms & Conditions form part of the agreement between you and me.

If there is any specific arrangement that differs from these Terms & Conditions, I will confirm this with you in writing.

2. The photography service

I will provide the photography service described in your booking confirmation.

I work in a discreet and documentary style and will make reasonable efforts to capture the important moments, people and details of the funeral or memorial service.

Photography at a funeral is naturally unpredictable. I cannot guarantee particular photographs, people appearing in particular images, specific moments being captured or particular group photographs.

This may be affected by:

  • the timing and circumstances of the service;

  • the wishes of the family;

  • the behaviour or availability of people being photographed;

  • restrictions imposed by the venue, celebrant, religious organisation or funeral director;

  • lighting, weather or other conditions;

  • restrictions on where I am permitted to stand or move.

I will always respect reasonable instructions from the family, funeral director, venue or officiant regarding photography.

3. Venue and photography restrictions

Some venues, churches, crematoria and other locations have their own rules about photography.

I cannot guarantee that I will be permitted to photograph every part of a service or every moment.

Where restrictions are imposed by a venue, celebrant, religious organisation or funeral director, I will comply with them.

I cannot be held responsible for photographs that cannot be taken because of restrictions outside my control.

4. Respect and discretion

I will work sensitively and discreetly throughout the service.

I may decide not to take a photograph if I believe that doing so would be inappropriate or disrespectful in the circumstances.

I will also respect reasonable requests from the family about particular people, moments or situations that they do not want photographed.

If there are specific wishes or sensitivities that you would like me to be aware of, please tell me before the service wherever possible.

5. Payment

The total price of the photography service will be confirmed before the booking is made.

A £150 booking payment is required to secure the date.

The remaining balance is due no later than 3 days before the scheduled photography service.

If you book less than 3 days before the service, the full amount is due at the time of booking

I will provide the payment details and due dates when the booking is confirmed.

If additional services or products are agreed after the original booking, I will confirm any additional charges with you before they are provided.

All prices and payment requirements will be clearly communicated before you commit to the booking.

6. Cancellation by you

I understand that circumstances surrounding a funeral can change unexpectedly.

If you need to cancel your booking, please contact me as soon as possible.

Where a booking is made online, by telephone or by another means that constitutes a distance contract, you may have a statutory 14-day right to cancel under consumer law. There are circumstances in which this right can be affected where you have expressly asked for the service to begin during that period, particularly where the service is completed during the cancellation period.

If your funeral photography is required within the 14-day cancellation period, I may ask you to expressly request that I begin providing the service before the cancellation period has ended.

Any statutory cancellation rights you have will not be removed by these Terms & Conditions.

If you cancel outside any applicable statutory cancellation period, I will consider the circumstances and any costs or commitments I have reasonably incurred in relation to the booking when determining whether any payment or refund is due.

I will not impose a cancellation charge that is disproportionate or unfair.

7. Cancellation or inability to attend by me

In the unlikely event that I am unable to attend the funeral or memorial service, I will let you know as soon as reasonably possible.

Where practical, I will try to help you find another suitable photographer.

If I am unable to provide the service and no suitable replacement can be arranged, I will refund any payment you have made for the service that I have been unable to provide.

8. Delivery of photographs

I will normally provide the finished photographs through an online gallery or secure download.

My normal delivery time is within 7 days, although this may occasionally take up to 14 days during particularly busy periods or where circumstances require additional processing time.

If there is likely to be a significant delay, I will let you know.

9. Image selection and editing

I will select the photographs that I consider to represent the service appropriately.

I will edit the selected photographs using my professional judgement and established photographic style.

I do not provide every photograph taken during the service.

Images that are technically unsuitable, duplicated, accidental or otherwise unsuitable for delivery may not be included.

Requests for substantial changes to my normal editing style may incur an additional charge if agreed in advance.

10. Copyright

Copyright in the photographs remains with Meena Julien trading as Loving Memories Funeral Photography.

Copyright is not transferred to the client when photographs are purchased.

You receive a personal, non-exclusive licence to download, store, print and share the photographs for your own personal and family purposes.

You may share the photographs with family members and friends.

You may also share them on personal social media accounts, provided that the photographs are not altered in a way that misrepresents my work and, where reasonably practical, Loving Memories Funeral Photography is credited.

You may not sell the photographs, license them to another person or business, use them for commercial purposes or submit them to publications or competitions without my written permission.

11. My use of photographs

I recognise that funeral photographs are particularly personal.

I will not automatically use photographs from a funeral for my website, social media, advertising, portfolio, publications or other promotional purposes.

If I would like to use a photograph for promotional purposes, I will ask for separate, specific permission.

You are free to say no. Your decision will not affect the photography service I provide.

If you give permission and later withdraw it, I will stop using the photograph for future promotional purposes, subject to any use that has already taken place and cannot reasonably be withdrawn.

12. Personal information and privacy

I collect and use personal information in order to respond to enquiries, arrange bookings, provide photography services, deliver photographs, process payments and meet my legal and business obligations.

I may also process photographs of people attending a funeral or memorial service.

My use of personal information is explained in my Privacy Policy, which forms part of the information provided to clients about my services.

You can read the Privacy Policy here:

13. Storage of photographs

I take reasonable steps to protect your photographs and personal information against loss, damage or unauthorised access.

My normal retention periods are:

  • Final edited photographs: 12 months after delivery.

  • RAW and working files: 3 months after delivery.

After these periods, files may be securely deleted.

I may retain information for longer where reasonably necessary because of an ongoing complaint, dispute, legal claim, insurance matter or other legitimate requirement.

Please ensure that you download and securely store your photographs once they have been delivered.

14. Technical failure, loss or damage

I use professional equipment and take reasonable steps to maintain and back up my equipment and files.

However, photography involves technical and environmental risks, and equipment or digital files can occasionally fail.

If photographs are lost or damaged because of an unexpected technical failure despite reasonable care, I will discuss the circumstances with you and provide an appropriate remedy where one is available.

Nothing in these Terms & Conditions excludes or restricts any legal rights or remedies that you have under applicable consumer law.

15. Personal safety

I will take reasonable care when working at a funeral or memorial service.

Clients and guests are responsible for their own personal safety and for following reasonable instructions given by the venue, funeral director or other person responsible for the location.

Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited.

16. Circumstances outside my reasonable control

Sometimes circumstances outside my reasonable control may affect my ability to provide the service.

These may include, for example:

  • severe weather;

  • flooding;

  • major transport disruption;

  • sudden illness or injury;

  • serious equipment failure;

  • venue closure;

  • changes to the funeral arrangements;

  • government restrictions;

  • other circumstances that could not reasonably have been anticipated or prevented.

I will communicate with you as soon as reasonably possible and take reasonable steps to minimise the impact.

17. Complaints

I want you to be happy with the service I provide.

If you have a concern or complaint, please contact me as soon as possible so that I have an opportunity to understand what has happened and try to resolve the matter.

18. Changes to these Terms & Conditions

I may update these Terms & Conditions from time to time.

The Terms & Conditions that apply to your booking will be the version provided or made available to you when you book, unless a change is required by law or is expressly agreed with you.

The latest version will be published on this website.

19. Governing law

These Terms & Conditions are governed by the laws of England and Wales.

Any dispute will be subject to the jurisdiction of the courts of England and Wales, subject to any rights you may have under applicable consumer law.
